IN RE: FORECLOSURE SALE OF THE REAL ESTATE KNOWN AS 2607 SHAWNEE AVENUE, BIG STONE GAP VA 24219

To whom it may concern:

At the request of the noteholder, Big Stone Gap Redevelopment and Housing Authority, (the “Beneficiary”), Big Stone Gap, Virginia, which Beneficiary is the owner and holder of a certain note made by Loretta Mullins, dated June 2, 2009, in the amount of $25,500.00, (the “Note”), which Note is secured by the lien of a certain deed of trust dated June 2, 2009 and recorded March 5, 2010, in the Wise County Circuit Court Clerk's Office as Instrument Number 201000725 (the “Deed of Trust”), encumbering the real estate and all improvements thereon known as 2607 Shawnee Avenue, Big Stone Gap in Wise County, Virginia (the “Property”), the undersigned sole acting trustee with full power to act gives notice as follows:

(l) That the note secured by the Deed of Trust is in default for nonpayment of monthly installments as provided in the Note.

(2) That the default was not cured as previously demanded by the Beneficiary.

(3) That the Note and all of the debts and obligations, including all principal, interest, and lawful charges, secured by the Deed of Trust are hereby accelerated and declared to be immediately due and payable in full; and

(4) That the aforementioned property will be sold by foreclosure proceedings at public auction unless the entire balance of the Note (including all principal, interest, and lawful charges) is paid in full before the sale hereinafter mentioned.

In connection with the foreclosure sale, you are hereby given the following information:

(l) DATE AND TIME OF FORECLOSURE SALE: May 28, 2024 AT 11:00 A.M.

(2) PLACE OF FORECLOSURE SALE: Wise Courthouse, Wise, Virginia

(3) PUBLICATION OF NOTICE OF FORECLOSURE SALE: In the legal notice part of the classified section of “The Post” beginning on April 18, 2024.

(4) TERMS OF FORECLOSURE SALE: Cash. A bidder's deposit of $500.00 cash may be required. The entire amount of the successful bid must be paid in full in cash within ten days after sale.

(5) EFFECT OF FORECLOSURE SALE: The sale will cause you to lose the property and you will have to give up possession of the property immediately following the foreclosure sale. You will be responsible for all costs and expenses permitted by law in connection with such sale, and should the Property not bring a sufficient sum to satisfy the Note in full (including all interest and lawful charges), you will be responsible for any deficiency.

(6) FORECLOSURE MADE SUBJECT TO EASEMENTS AND RESTRICTIONS: The sale will be made subject to all existing easements and restrictive covenants as the same may lawfully apply to the property.

(7) AMOUNTS NEEDED TO AVOID FORECLOSURE: Payment in full before May 28, 2024.

Enclosed for your information is a copy of the foreclosure advertisement that will be published as stated herein.

This notice is sent to each of the present owners of the property by certified mail at least fourteen days prior to the foreclosure sale at the last known address for each such owner shown on the books and records of the Beneficiary.

Should you desire to avoid the necessity of a foreclosure sale and satisfy your obligation, you should contact the undersigned immediately.
